RENTAL AGREEMENT

Shipping

Renters (AKA Clients) will choose a duration period for renting in 5- day increments. Renters will select the first day of the rental period as the date of their event. The device must be shipped back by the end of the rental duration. If the device is not shipped back by the designated date, the renter will be charged $100 per day until the device is returned.

Cancellation and Rescheduling

• If rental is cancelled 30 days before the event date, renter forfeits the deposit of the rental minus sales tax paid (up to 50% of total rental due is refundable minus sales tax paid)

• If rental is cancelled with less than 30 days before the event date, all amounts paid will be forfeited (0% is refundable)

• Rentals can be rescheduled up to 20 days before the event date at no extra charge, subject to availability.

 

Audio Digital File & Film Copyrights

All copyright is shared between Memories Out Loud and the client. Both Memories Out Loud and the client have full rights to reproduce images and audio. Memories Out Loud may use the images for promotional material on the internet and in print form. The renter agrees to release all claims to profits that may come from the use of the images.

Images may not be used for commercial purposes without written consent of Memories Out Loud.

Gift Certificates

Gift certificates cannot be exchanged for cash or refunded. Purchase price must be greater than or equal to the certificate value.

Limits of Liability

The greatest care will be taken in regards to exposure, transportation, and processing the digital audio. However, in the unlikely event that digital audio has been lost, stolen, or destroyed for reasons within or beyond our control, liability is limited to the return of all payments received for the audio guest book rental from Memories Out Loud. The limit of liability for partial loss of originals shall be a pro-rated amount of audio clips lost based on the percentage of total number of originals.

In the event where digital audio files are affected due to failure of our equipment, liability is limited to the return of all payments received for the audio guest book rental from Memories Out Loud.

In the event where there is downtime due to reasons outside of our control, Memories Out Loud will not be held liable.

Creative Editing

Audio clips are edited at the discretion of Memories Out Loud and delivered digital files may not include all audio clips captured. The client agrees that Memories Out Loud reserves the creative right to edit and release only those that are “professional quality" and within the standards of Memories Out Loud.
 

We reserve the right to not include digital audio from any publicly viewable gallery on our site that are adult in nature. However, you as the client will still receive the full audio in your digital file and/or optional purchasable usb drive.

 

Additional Terms & Conditions

The renter agrees that they are liable for any loss or damage that they or their guests may cause to any of the audio guest book rental equipment: including but not limited to the phone and its internal technology, box, packaging, frame and battery pack & cables. Up to $2,000. (Itemized price list for damages / loss of equipment will be provided if items are missing or damaged when Audio Guestbook is returned).

 

We may use your details to promote products and services in the form of email communications and/or other types of communication.
